　　The Eastern Area of Kangbashi District in Ordos extends to Tianjiao Road in the west,Wulanmulun Street in the south,and Duorina Road in the east.The northern part includes Kaokaoshina Area.There are three areas,namely the former industrial area,former residential area,and Kaokaoshina Area,covering an area of approximately 6.79 square kilometers(excluding the water area).The level of details should meet the requirement of urban design at the regulatory plan stage.

　　4.1應(yīng)征申請(qǐng)人（以下簡(jiǎn)稱“申請(qǐng)人”）應(yīng)為合法注冊(cè)的法人實(shí)體或由合法注冊(cè)的法人實(shí)體組成的項(xiàng)目聯(lián)合體。

　　4.2 Applicants shall have the professional and technical ability to undertake the planning design of this solicitation project.
　　4.2.1中華人民共和國(guó)境內(nèi)的申請(qǐng)人應(yīng)具有城鄉(xiāng)規(guī)劃編制甲級(jí)或工程設(shè)計(jì)建筑行業(yè)（建筑工程）甲級(jí)及以上資質(zhì)。
　　4.2.1 Applicants within the People's Republic of China should have a qualification certificate of Grade A for urban and rural planning or a qualification certificate of Grade A for architectural design(architectural engineering)or above.
　　4.2.2中華人民共和國(guó)境外的申請(qǐng)人須依所在國(guó)或所在地區(qū)的管理規(guī)定具有城鄉(xiāng)規(guī)劃或城市設(shè)計(jì)或建筑設(shè)計(jì)的執(zhí)業(yè)許可或經(jīng)營(yíng)許可。
　　4.2.2 The Applicants outside the People's Republic of China should have a practice license or business license for urban and rural planning,urban design,or architectural design in accordance with the national or local administrative regulations.
　　4.3中華人民共和國(guó)境外的申請(qǐng)人須與境內(nèi)的申請(qǐng)人組成聯(lián)合體。
　　4.3 Any Applicant outside the People's Republic of China shall form a Consortium with an Applicant inside the People's Republic of China.
　　4.4香港、澳門特別行政區(qū)和臺(tái)灣地區(qū)的設(shè)計(jì)機(jī)構(gòu)的資格要求參照境外設(shè)計(jì)機(jī)構(gòu)資格要求的規(guī)定。
　　4.4 The qualifications for design entities from Hong Kong and Macau Special Administrative Regions as well as Taiwan shall refer to the requirements of qualifications for design entities outside the People’s Republic of China.
　　4.5本項(xiàng)目接受聯(lián)合體申請(qǐng)。聯(lián)合體成員的數(shù)量不超過三個(gè)，組成項(xiàng)目聯(lián)合體的各成員單位不得再以自己的名義單獨(dú)申請(qǐng)資格預(yù)審，也不得同時(shí)加入本項(xiàng)目其它聯(lián)合體申請(qǐng)資格預(yù)審，本項(xiàng)目不接受自然人及自然人組合的申請(qǐng)。
　　4.5 This Project accepts applications from a Consortium.The number of members of a Consortium should not exceed three.Any partner of the Consortium shall neither individually apply for the prequalification in its own capacity,nor concurrently apply for the prequalification as a partner of another Consortium.This Project does not accept applications from natural persons or combinations of natural persons.

　　8.1.2應(yīng)征人對(duì)其設(shè)計(jì)成果享有署名權(quán)，在征得主辦單位/承辦單位書面同意后可通過傳播媒介、專業(yè)雜志、書刊或其他形式評(píng)價(jià)、展示其設(shè)計(jì)成果的相關(guān)內(nèi)容。除應(yīng)征人的設(shè)計(jì)標(biāo)準(zhǔn)、設(shè)計(jì)導(dǎo)則和繪圖元素以外，應(yīng)征人不得將設(shè)計(jì)成果用于其他的設(shè)計(jì)項(xiàng)目。

　　8.1.3 Participants shall ensure that all submitted design results have not infringed upon and will not infringe upon IPRs(including but not limited to copyright and patents)or proprietary technologies or trade secrets of others within or outside the People’s Republic of China.Participants shall guarantee that if their design results use or include IPRs or proprietary technologies or trade secrets of others,Participants shall have already obtained legitimate,valid and sufficient authorization from the right holders.Participants shall take all liabilities for any compensations arising from infringement upon IPRs or know-how or trade secrets of others.
　　8.1.4主辦單位/承辦單位有權(quán)在本項(xiàng)目的規(guī)劃設(shè)計(jì)中使用應(yīng)征人提交的設(shè)計(jì)成果，主辦單位/承辦單位在項(xiàng)目的規(guī)劃設(shè)計(jì)中或在規(guī)劃設(shè)計(jì)方案調(diào)整綜合時(shí)可以全部或部分使用設(shè)計(jì)成果的內(nèi)容，也可以對(duì)其進(jìn)行修改。主辦單位/承辦單位不得將設(shè)計(jì)成果用于本項(xiàng)目以外的其他項(xiàng)目。
　　8.1.4 The Sponsor/Organizers have the right to use the design results submitted by Participants in the planning and design of this Project.The Sponsor/Organizers are allowed to use the design results in whole or in part in the planning and design of this Project or the adjustment and integration of the planning and design proposals,and have the right to modify them.The Sponsor/Organizers shall not use the design results for a purpose other than this Project.
　　8.1.5主辦單位/承辦單位可以對(duì)所有設(shè)計(jì)成果印刷、出版和展覽，并可通過傳播媒介、專業(yè)雜志、書刊或其他形式評(píng)價(jià)、展示、宣傳應(yīng)征規(guī)劃設(shè)計(jì)成果，但應(yīng)注明應(yīng)征規(guī)劃設(shè)計(jì)機(jī)構(gòu)的名稱。
　　8.1.5 The Sponsor/Organizers can print,publish and exhibit all the design results,or comment on,display and publicize the planning and design proposals via media communications,trade magazines,publications or by other means.The precondition is indication of the names of the planning and design entities for such design.
　　8.1.6建筑設(shè)計(jì)方案（如果有）的著作權(quán)歸屬于應(yīng)征人，但景觀小品及其建構(gòu)筑物除外。
　　8.1.6 The copyright of architectural design proposals(if any)shall belong to the Participants,except for landscape embellishments and their structures.

　　承辦單位將向按征集文件的要求在規(guī)定的時(shí)間內(nèi)提交了有效應(yīng)征文件的應(yīng)征人支付應(yīng)征設(shè)計(jì)補(bǔ)償金，金額為人民幣230萬元（含稅）。當(dāng)應(yīng)征人出現(xiàn)下列情況時(shí)，承辦單位不予支付補(bǔ)償金：
　　The Organizers will pay compensations for Designs Proposals to Participants who have submitted valid response proposals at the specified time in accordance with the requirements of the Solicitation Documents.The amount is RMB 2.3 million(including tax).The Organizers will not pay any compensation when Participants are under any of the following circumstances:
　?。?）應(yīng)征人未按規(guī)定時(shí)間提交應(yīng)征文件；
　?。?）應(yīng)征人提交的應(yīng)征文件經(jīng)專家委員會(huì)評(píng)審被認(rèn)定為未對(duì)征集文件要求作出實(shí)質(zhì)性響應(yīng)；
　?。?）應(yīng)征人被取消應(yīng)征資格。
　?。?）Participants fail to submit their response proposals within the specified time;
　　（2）The response proposals submitted by Participants are judged,upon the expert review,as not substantially responding to the requirements of the Solicitation Documents;
　?。?）Participants are disqualified.
　　8.3獎(jiǎng)項(xiàng)的設(shè)置
　　8.3 Awards settings
　　本次國(guó)際征集將通過專家評(píng)審選出2個(gè)優(yōu)勝應(yīng)征規(guī)劃設(shè)計(jì)成果，不排序。隨后主辦單位會(huì)將本次國(guó)際征集的優(yōu)勝應(yīng)征規(guī)劃設(shè)計(jì)成果和其他應(yīng)征設(shè)計(jì)成果向公眾進(jìn)行展示，接收社會(huì)各界的意見和建議，最終通過綜合評(píng)估，確定排序第一和排序第二的優(yōu)勝應(yīng)征規(guī)劃設(shè)計(jì)成果。排序第一的優(yōu)勝應(yīng)征規(guī)劃設(shè)計(jì)成果的應(yīng)征人可獲得獎(jiǎng)金人民幣90萬元（含稅），排序第二的優(yōu)勝應(yīng)征規(guī)劃設(shè)計(jì)成果的應(yīng)征人可獲得獎(jiǎng)金人民幣50萬元（含稅）。
　　The International Solicitation will select two winning planning and design proposals through expert review,with no ranking.After that,the Sponsor will publicize the winning planning and design proposals and other response proposals in the International Solicitation,receive opinions and suggestions from all walks of life,and finally determine which winning proposal ranks first and which ranks second through comprehensive evaluation.The Participant that ranks first for the winning planning and design proposals will be rewarded RMB 0.9 million(including tax),and the Participant that ranks second will be rewarded RMB 0.5 million(including tax).

　　8.4 Follow-up work
　　主辦單位將委托獲得優(yōu)勝應(yīng)征規(guī)劃設(shè)計(jì)成果的應(yīng)征人完成本項(xiàng)目的城市設(shè)計(jì)方案綜合和控制性詳細(xì)規(guī)劃的編制，總費(fèi)用人民幣595萬元（含稅），其中城市設(shè)計(jì)方案綜合費(fèi)用為人民幣290萬元（含稅），控制性詳細(xì)規(guī)劃編制費(fèi)為人民幣305萬元（含稅）。
　　The Sponsor will entrust the Participant whose planning and design proposal is selected as the winning proposal to complete the development of the general and regulatory plans for the urban design proposal of this Project,with a total cost of RMB 5.95 million(including tax),including the expenses for the integration of urban design proposals of RMB 2.90 million(including tax),and the expenses for the preparation of regulatory plans of RMB 3.05 million(including tax).
